This website is operated by Orkney Storehouse. Throughout the site, the terms “we”, “us” and “our” refer to Orkney Storehouse. Orkney Storehouse offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the site.

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms & Conditions are considered an offer, acceptance is expressly limited to these Terms & Conditions.

Any new features or tools which are added to the current store shall also be subject to the Terms & Conditions. You can review the most current version of the Terms & Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms & Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to the website following the posting of any changes constitutes acceptance of those changes.

Orkney Storehouse aims to provide every customer with goods of the highest quality and the same excellent level of service. If for any reason you are not entirely happy with the goods or services provided, please contact us and we will do our best to resolve any issue.

SECTION 2 - MAKING A CONTRACT WITH US

When you place an order with us, you are making an offer to buy goods. We will send you an email to confirm that we have received your order. Once we have checked the price and availability of the goods, we will email you again to confirm that we accept your order and that a contract has been made between us. We will not take payment from you until we have accepted your order.

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an email confirming acceptance of your order and there will be no contract between us.


SECTION 3 - HOW TO PLACE AN ORDER

In order to make a purchase, browse through our products on our online shop, and click on any items that you wish to buy and put them into your ‘Shopping Basket.’ After you have finished your selection, click on 'View Basket & Checkout' and you will be asked for details required to fulfil the order.

Promotional discounts are sometimes offered for a limited time. Details and expiry details will be communicated accordingly at the time the discount is offered.

SECTION 4 - PAYMENT

The Orkney Storehouse website is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you. When you go through the payment process at Checkout, Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS, as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - DELIVERY

We use Royal Mail delivery services for dispatch of goods. In the UK we use UK Standard delivery, which can be either 1st or 2nd class delivery. For all orders above £50 in value, we use UK Confirmed, requiring a signature on delivery. All delivery times are based on working days, all bank holidays are classed as non-working days. All our delivery dates are estimates and we cannot guarantee specific deadlines. Please note, we cannot be held responsible for any third-party involvement where delays occur to deliveries.

We deliver to all postal areas in the UK, including Northern Ireland plus most countries outside the UK including the Republic of Ireland.

For UK orders over £80, delivery is free of charge.

Please note that for international orders, customers are responsible for all duties and customs charges. If you are unsure how this will affect the overall cost of your order, please check your Local Legislation rules.

To amend an order or delivery address, please contact us immediately. We will do our best to make amendments prior to dispatch, but we cannot guarantee changes can be made once an order is processed. An order may incur additional charges if a change of delivery address is requested after the goods have been dispatched.

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

Your products will be packaged safely and securely for shipment in a cardboard box or package, depending on the item.  All orders are sent out in plain packaging.

SECTION 6 - CANCELLATION, RETURNS & EXCHANGES

If, after Orkney Storehouse has accepted an order from you (acceptance will be communicated via e-mail on receipt of an order) and you wish to withdraw from the contract, you may do so by communicating that to us within 24 hours of our acceptance.

If you have already received the goods and they are unwanted, you must return the goods to us at your own cost and risk. This will not apply in the case of faulty, damaged or incorrect goods. It is imperative that you notify us within 5 working days of receipt of goods if they are faulty. Provided the goods are returned in the same condition as we supplied them to you, we shall reimburse all monies, including standard delivery charges, paid by you for those goods. If you have opted to pay for a more expensive delivery method, we shall only refund the cost of the goods and the standard delivery charge.

If we find that the product has not been returned to us in fully resalable condition, we reserve the right to refuse a refund on the item.  Please ensure that the items are safely packaged and return to us using a signed for delivery service and include a completed Returns Form stating the reason for return.  We cannot be held responsible for items that are lost in transit whilst being returned to us.

If it is an international return, please clearly label the package "Returned for Repair" or "Returned for Refund".  This will ensure that your returned goods are not held in UK customs, which could otherwise result in delays in processing your refund.

For products purchased online at www.orkneystorehouse.com, we will be more than happy to offer you an exchange provided that you notify us by email or letter within 14 calendar days from date of receipt of the item of your intention to return the goods to us in its original condition, with the original packaging and sales receipt. Goods must be received by Orkney Storehouse within 21 days from date of receipt of goods.

If you are exchanging goods and the new item you require costs less than the one you have returned we will refund you the difference. If exchanging goods and the new item you require costs more than the one you returned an additional payment will be needed.

Refunds for items bought as gifts can only be given to the original purchaser.

In the case of exchanges, a re-delivery charge will apply as per our schedule of delivery charges.

Our Returns Policy does not affect your statutory rights.

SECTION 7 - FAULTY GOODS

Orkney Storehouse makes every effort to ensure that the items we sell are of the highest quality. Should you be unlucky enough to receive an item which you consider to be faulty, please contact us within 30 days of purchase and let us know the details of the fault. Orkney Storehouse will then advise whether to return it or not and make sure other items are not affected. We may ask you to email us a photograph of the fault as it's easier for you than posting it back to us. Should you need to return the item we will refund any postage on a faulty item, and ensure you are reimbursed for standard return postage on the item.

If a fault develops outside of the 21 day return period, please contact us on 01856 851222 (Monday - Friday 9 am to 5 pm) or by email on customerservices@orkneystorehouse.com before you return the item so we can discuss the fault with you and agree the best way forward.

Please take extra care to read any product care information for specific products. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is due to wear and tear or misuse.

SECTION 8 - COMPLAINTS

The following terms and conditions do not affect your statutory consumer rights. If goods do not reach you in good condition or are faulty, carriage costs for the affected portion of delivery back to Orkney Storehouse is at our expense. You must contact us to arrange return delivery. Your complaint will be acknowledged within 2 working days and we will keep you well informed about progress. Orkney Storehouse will only credit you for the items that have been damaged or are faulty upon safe receipt of the goods into our hands. Refunds will be furnished within 14 days of the agreement to refund or within 14 days of receiving proof that the goods have been sent back to us.

SECTION 9 - VAT

All prices shown are inclusive of VAT in the United Kingdom.  VAT will be deducted on the checkout page for items delivered to overseas addresses.

SECTION 10 - PRODUCT IMAGES AND DESCRIPTIONS

We make every effort to ensure that images displayed on our website are as accurate as possible but cannot guarantee an exact match to the product as displayed on your screen.  All product information and technical specifications contained in Orkney Storehouse are for guidance only, no responsibility can be taken for errors or omissions.

SECTION 11 - SECURITY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

SECTION 12 - DATA PROTECTION

Orkney Storehouse conforms to the UK Data Protection Act. Any information you provide is treated in strict confidence and is stored in a secure location. Customer details will not be disclosed in any way to any persons out with Orkney Storehouse. If you do not wish to receive promotional material from us, please register that with us immediately by e-mail. Please view our Privacy Policy.

SECTION 13 - THIRD PARTY LINKS

Certain content, products and services available via our Service may include materials from third-parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 14 - USER COMMENTS, FEEDBACK & OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example competition entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms & Conditions.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 16 - TERMINATION

Orkney Storehouse reserves the right to abort access to our internet services if your behaviour is found to be discordant with these terms and conditions at any time.

ALL RIGHTS RESERVED.

These Conditions of Use are governed by Scots law.

SECTION 18 - GOVERNING LAW

These Terms & Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Scotland.
